1. Definitions

For the interpretation and implementation of these general terms of sale, it is agreed that the following terms are defined as follows:
"Terms" means these terms and conditions.
"Customer" means the natural or legal person established in France or abroad, which orders a Product(s) sold by the Publisher on the website Hprints accessible at http://hprints.com.
"Publisher" means the publisher of the website accessible at http://hprints.com, whose coordinates are specified below in the article "Identification".
"Hprints" means the website accessible at http://hprints.com.
"Product" means the products sold on the website Hprints accessible at http://hprints.com.



2. Object

These Terms are intended to define the contractual relationship between the Publisher and the Customer. The Customer declares to have read and expressly accept without limitation or qualification the terms of these Terms. Any order placed by the Customer constitutes acceptance of these Terms.
All sales of products on Hprints are exclusively governed by these Terms.
The applicable version of the Terms is searchable online version at Hprints at the time of order. The Publisher reserves the right to modify at any time these Terms. The amended Terms will apply only after they have been placed online orders on the said site.
The Customer declares (I) be at least eighteen (18) years old and have the legal capacity or (II) hold a parental authorization to perform a command on Hprints.



3. Duration

These Terms are effective when placed online Hprints and will apply to all orders placed after they will be put online. The latest version of the Terms has been online since May 26th, 2014.
These Terms are concluded for an indefinite period.



4. Order

All orders are sent to the Publisher by the Customer via the http://hprints.com website.
To place an order, the Customer must select Product(s) and put it(them) in his shopping basket by clicking the button "Add to basket" for each listing.
The Customer can at any time access to the composition of the basket, which is always visible at the top right of Hprints.
Once finished shopping and the basket verified and validated by the Customer, he(her) must select the country of delivery and mode of delivery and then identify himself(herself) stating in particular the delivery address and then select the payment method.
Any order is subject to validation by the Publisher. This validation will occur upon receipt of payment of the order.
Validation takes the form of an email sent by the Publisher to the Customer to the email address informed by the latter during the ordering, and will summarize details of the order, the name of the product, the quantity ordered, the Product(s) price(s), the payment terms, the anticipated date of shipment and will mention a link to a printable invoice. The date of validation of the order shall be deemed to be the date of receipt by the Customer of this email validation.
The publisher is free to refuse any order that can not be satisfied for any reason whatsoever. The publisher then reimburse the Customer any amount already paid for the payment of the order.
The date of completion of the sale is deemed to be the date of validation by the Publisher of the order(s) who has(have) been addressed to him by the Customer, or the date of receipt of the email validation.

5. Products

Hprints essentially offers old adverts extracted from vintage periodicals, reviews or magazines. Hprints also offers illustrations, photographs and engravings published in journals, magazines and vintage trade catalogs.
The state of the product is clearly stated in the listing. The dimensions of the product, date of publication, the brand, the name of the illustrator or photographer and any other information mentioned in the description are provided for illustrative purposes only.
Any additional information concerning a product and its status can be communicated by the Publisher upon customer request sent to the email address .
Products selected by Hprints are not reproductions or reprints. Hprints only offers paper products that have already been published. Accordingly, the Customer may not purchase Products in electronic format.
The Customer is also informed that the goods or services covered by advertisements or other products offered by Hprints are not sold.
The publisher does not give rights of reproduction on Product(s) sold.



6. Products availability

The responsibility of the Publisher can not be held liable for unavailability of all or part(s) Product(s).
The Publisher will notify the Customer of any potential unavailability of a controlled product.
The Customer may then cancel the order within thirty (30) working days and the Publisher will reimburse the Customer the price of the unavailable products. This reimbursement will be made ​​by the same means of payment used by the Customer.



7. Price

Products are sold to the Customer by the Publisher at its current rate at the date of the order on Hprints.
The price is firm and final. It does not include shipping fee (shipping, handling, packaging) which are charged extra.
Customer may choose to display the prices in euros or U.S. dollars.
Prices shown include VAT, and therefore the VAT applicable on the date of the order rate. Any change in this rate will be reflected in the selling price of the Products.
The Publisher is free to change prices at its sole discretion, including due to unforeseen external factors such as general price trends.
The new tariff conditions apply to all orders passed after the publication of new prices on Hprints.



8. Terms of payment

Four payment methods are offered by Hprints.

- Credit card (Euros only)
First, payment by credit card (credit card, Visa, Mastercard, Maestro, E-cartebleue, Visa Electron). All online payments are secured by Banque Populaire - Rives de Paris and its online payment solution: Cyberplus Paiement. Offer Cyberplus Paiement is based on the technical platform Systempay developed through a partnership between Natixis Payments and LYRA NETWORK.

The control is automatically validated after receiving the payment authorization of the Client's bank.

- PayPal
Second, payment with PayPal. The Customer will be automatically taken to their PayPal account if it has one. Opening an account is not required to pay via PayPal. Customer can also just enter his bank details.
All payment is processed securely on the PayPal website accessible at https://www.paypal.com. No banking information is communicated to the Publisher who does not receive a confirmation or denial of the Customer payment.
The order is confirmed after receipt of payment authorization by PayPal.

- SEPA money transfer (only for Customers established in SEPA)
Then a transfer payment SEPA ("Single Euro Payments Area") to the bank account of the Publisher whose bank details as IBAN ("International Bank Account Number") and BIC ("Bank Identifier Code") are communicated to payment of the order.
After selecting this payment method when ordering, the Product(s) selected by the Customer shall be reserved. The Customer shall then fill out a form by filling including name, email address and shipping address.
The order is confirmed after receipt of payment authorization by SEPA.

- Cheque (only for Customers based in France)
Finally, a payment by check in euros drawn on a bank necessarily domiciled in France.
After selecting this payment method when ordering, the Product(s) selected by the Customer shall be reserved. The Customer shall then fill out a form by filling including name, email address and shipping address. He subsequently send a check made ​​payable to the Publisher wording of the total order amount in euros and sent to the mailing address listed below in the section "Identification".
The order is confirmed after receipt of check. Failing receipt of the check within ten (10) days of the order or in case of rejection of the check, the Publisher reserves the right to cancel the order.



9. Order execution

All orders will be processed within twenty-four (24) hours after validation. Packages are sent to La Poste within two (2) business days following.



10. Terms of delivery

The publisher gives special attention to the packaging of Products.
Fragile Products are first inserted into a polyethylene sleeve then carefully wrapped in several layers of carton pouch. The resistant packaging are composed of four layers of reinforced cardboard.



11. Delivery

Products are delivered in all countries of the world from Paris, by the French postal service La Poste.
Shipping fees are the responsibility of the Customer. They are calculated automatically according to the estimated total weight of the order, the country of delivery, and the delivery service selected by the Customer. Insurance and postal tracking are optional.
For delivery outside the territory of the European Union, the Customer must pay customs duties and other taxes payable in respect of the importation of Product(s) in the territory of delivery.
The Priority Mail delivery fees are offered for all orders exceeding 120 € (or $150), except orders including at least one magazine.
Shipping delays are provided by the Publisher to the Customer as a guide, they are not binding, if any, the postal service on which they depend exclusively. No compensation will therefore be asked to Publisher in case of the missed deadline.
Furthermore, the Publisher is not responsible for any loss or damage of the package due to the postal service.
Products are shipped to the address provided when ordering. In case of error or change the delivery address, the Customer must contact within twenty-four (24) hours of the order, an email to the email address to communicate to the Publisher the address at which he wishes to be delivered.



12. Complaint

It is up to the Customer to verify the number, and the status of compliance of the Product(s) ordered upon receipt.

13. Right of withdrawal

Accordance with Articles L.120 - 20 and following of the French Consumer Code, the Customer has a period of seven (7) days of receipt of the Product(s) to exercise his right of withdrawal from Hprints without reasons or to pay a penalty.
Upon exercise of the right of withdrawal by the Customer, only the purchased Product(s) price and shipping costs will be reimbursed by Hprints ; the return shipping costs are the responsibility of the Customer who accepts.

14. Delivery Address - Wrong Address

If no one can receive the Products to the address indicated in the order, a delivery notice will be filed.

In case of cancellation of the order, the Publisher commits itself within thirty (30) days of cancellation by the Customer or refund the Product(s) price, excluding delivery costs, customs duties and other taxes or, at its option, issue a credit note for the Product(s) price, excluding shipping costs, customs duties and other taxes, usable for any new order for six (6) months from the date of issue ; the return costs are in both cases the responsibility of the Customer who accepts.
In case of returning the Products to the address indicated, the delivery charges will be borne by the Customer who accepts.
If the Customer does not respond within ten (10) days after sending the email, the order will be canceled and Product(s) returned to the Publisher. The Publisher undertakes within thirty (30) days of receipt of Product(s) to refund the Product(s) price, excluding shipping costs, custom duties and other taxes and after deducting the eventual return costs.



15. Reservation of ownership

The Publisher reserves the Product(s) property until full payment.
In case of total or partial non payment of the total amount, for any reason and for any reason whatsoever, the Publisher reserves the right, as of right and without formality, to suspend delivery until regularization of the accounts receivable.



16. Intellectual Property

The website http://hprints.com, the source code as well as texts on Hprints are and remain the exclusive property of the Publisher.
Any total or partial reproduction of these items for any reason whatsoever, without the express, prior written consent of the Publisher, is strictly prohibited.



17. Responsibility

The Publisher undertakes to respect the laws and regulations in force in France. Consequently, no legal provision country-specific delivery can not be enforced against him.
In any event, it is expressly provided that the liability of the Publisher in respect of any damage will be limited to the amount of the order giving rise to such damage.



18. Privacy

The personal data collected by the Publisher are being processed by the latter within the meaning of the law n° 78-17 of 6 January 1978 amended by Law No. 2004-801 of 6 August 2004, which purpose is strictly necessary for the provision of the Products.
The Publisher agrees to comply with all legal and regulatory requirements regarding the protection of personal data in particular to ensure the security and confidentiality of such data.

19. Force majeure

The publisher can not be held liable to the Customer for the case where the performance of its obligations is delayed, limited or rendered impossible, because of the occurrence of an event of force majeure.
Are regarded as force majeure assumptions usually recognized by the courts and the French courts.
The occurrence of an event of force majeure suspend handling of all order(s) for a period which may not exceed one (1) month.
In the event that the force majeure would continue beyond the period mentioned above, the Publisher can pronounce the resolving of the order(s).



20. Identification

21. Nullity

If any provision of these Terms were to be declared void or unenforceable by reason of any law, regulation or following a final decision of a competent court, only that provision is void, the other provisions remain in full force and effect.



22. Applicable law - Jurisdiction

These Terms are governed by French law.
In the absence of agreement, any dispute relating to the validity, application or interpretation of these Terms shall be subject to the exclusive jurisdiction of the Commercial Court of Paris, notwithstanding appeal or multiple defendants, even for emergency procedures or interim interlocutory application or procedures.
